TradingGrader User Agreement

Introduction
1.1 Overview
TradingGrader is a platform providing analytics on user-linked traditional and crypto accounts. Integrations with Plaid and blockchains allow you to view investment performance, share results publicly (if you choose), and optionally interact with the GRADER token or NFTs.
1.2 Acceptance of Terms
By creating an account or using TradingGrader, you agree to this User Agreement and our Privacy Policy. If you disagree, you must cease using the Service.
User Accounts
2.1 Registration & Eligibility

You must provide accurate, up-to-date information and be at least 18 years old (or legal age in your jurisdiction).
You remain responsible for protecting your account and log-in credentials.

2.2 Linking Financial Accounts

By linking financial accounts via Plaid or connecting a Web3 wallet, you authorize TradingGrader to access relevant data solely for performance evaluations and related features.
You certify that you have lawful authority to link any account. If you are not the account holder, you must not connect it.
TradingGrader does not perform KYC checks to verify that a user connecting an account is its legitimate owner.
Users may link accounts they do not own, potentially misrepresenting performance. TradingGrader disclaims all liability arising from false or fraudulent account ownership or claims.

TradingGrader provides portfolio metrics, historical performance, and grading. The grading is algorithmic and does not constitute financial advice.
3.2 Public Data Sharing
You can opt to share transaction details or portfolio summaries publicly, including real-time updates. Once enabled, these details may be visible to others on the platform or through shared links.
3.3 Web3 & Token Features
If you interact with the GRADER token or NFTs, you acknowledge these features are experimental, may be restricted in certain jurisdictions, and involve inherent blockchain risks.

Any “top traders” or “leaderboards” displayed are purely informational, based on aggregated user data and do not imply endorsement or advice.

If you reside in a region where regulations may prohibit certain features (e.g., token purchases), you are responsible for complying with local laws.
TradingGrader reserves the right to limit or block access to certain jurisdictions if laws or regulations make the platform’s features impermissible.

You agree to submit only true and accurate data; do not misrepresent ownership of any linked account or manipulate performance.
6.2 Respect for Others
Refrain from sharing defamatory, harassing, or infringing content. We may remove such content or suspend accounts.
6.3 Regulatory Compliance
You alone are responsible for ensuring your use of TradingGrader is lawful in your jurisdiction.
If you suspect an account or transaction is fraudulent or unauthorized, notify us promptly.

Our collection and use of personal or financial data is governed by the [Privacy Policy].
By using TradingGrader, you consent to such data handling practices.

TradingGrader’s services, analytics, metrics, and content are provided “as is” without warranties of any kind (express or implied).
We do not guarantee uninterrupted service, nor the accuracy of data from external providers (Plaid, blockchain explorers, etc.).

To the maximum extent allowed by law, TradingGrader is not liable for any direct, indirect, incidental, or consequential damages arising from your use of (or inability to use) the platform.
We specifically disclaim liability for user reliance on performance grades, published transaction data, or any claims of misrepresentation by other users.

$GRADER is intended solely as a utility token to access platform features, rewards, or memberships. It is not designed as an investment or security.
10.2 Legal Compliance
Depending on your jurisdiction’s laws, $GRADER may not be offered, sold, or distributed to you. TradingGrader reserves the right to geoblock certain token features.
10.3 Assumption of Risk
You assume all risk relating to cryptocurrency volatility, potential hacks, or regulatory changes.
TradingGrader cannot prevent token trading on third-party exchanges or DEXs and disclaims liability for secondary market activity.
10.4 No Guaranteed Value
TradingGrader does not guarantee $GRADER or any NFT will have any monetary value. Any perceived value is subject to market speculation or user demand.

You acknowledge that TradingGrader may modify or discontinue free tiers, requiring a paid subscription in the future.
Notice will be given for significant changes, and continued use indicates acceptance.

You may terminate your account at any time; upon termination, we will remove or anonymize your data as required by law.
TradingGrader may suspend or terminate accounts violating these terms, law, or that pose legal risks.

You agree to indemnify and hold TradingGrader harmless from any claims or losses resulting from your misuse of the platform, violation of local laws, or infringement of others’ rights.

This Agreement is governed by the laws of [insert appropriate jurisdiction, e.g., Delaware or California], unless local consumer protections mandate otherwise.
Any disputes may be resolved via arbitration or as otherwise stated in local laws. Class action waivers may apply if enforceable in your jurisdiction.

If any provision is found invalid under applicable law, the rest of the Agreement remains enforceable.
We may update this Agreement. Material changes will be communicated; continuing to use TradingGrader after updates is deemed acceptable.

By using TradingGrader, you confirm you have read, understood, and agree to this updated User Agreement.
